City EMS blamed in choking lawsuit

A $1.25 million civil court judgment is being sought against the City of Pawhuska by family members of a local woman who died after choking on a piece of meat during a May 2012 outing.

According to the petition for a wrongful death lawsuit filed Dec. 16 in Osage County District Court, Kathleen Marie Baker of Pawhuska became choked May 12, 2012, while she was at the Osage Casino-Pawhuska.

The suit alleges that the city-operated Pawhuska EMS ambulance did not arrive for at least 30 minutes after being called to the scene. Baker reportedly died in the presence of her daughter, Katrina Marie McFadden, the lawsuit states.
